BLOOR Homes is being investigated about building work being carried out at the Garston Road site outside of permitted hours.
Mendip District Council put a planning contravention notice in place on Friday, July 12 after a number of complaints were received.
A Mendip council spokesperson said: "Our enforcement team is currently investigating complaints received from local residents regarding building works being carried out at Garston Road, Frome, not complying to planning conditions.
"We have received complaints stating that the building works were consistently being carried on outside the permitted hours.
"Having contacted Bloor Homes, the developer of the site, we have been assured that this was due to bad weather causing delays and they were endeavouring to deliver the contracted properties on time. They have also assured us that it will not happen again. Mendip District Council will continue to monitor this situation."
The Frome Standard contacted Bloor Homes for a comment but at the time of going to press the company had not responded.
